- Section 208 of the Constitution of the Republic of South Africa Act 1996 (Act No. 108 of 1996), (‘the Constitution’) requires that a Civilian Secretariat for the Police Service
must be established by national legislation to function under the direction of the Cabinet member responsible for policing. The Civilian Secretariat for Police Act 2 of 2011, (‘the
Act’) has been developed to give effect to section 208 of the Constitution.
- The Act makes provision for the establishment of provincial secretariats to support the Civilian Secretariat to achieve its objects, perform functions and exercise powers of
the Civilian Secretariat at the provincial sphere of government in accordance with the principles of co-operative government and intergovernmental relations contained in Chapter
3 of the Constitution.
